Cosmetology: What is an allergen?
An allergen, which can be of natural or synthetic origin, is a substance foreign to the body that can trigger a hyperactive response from the immune system. In cosmetics, allergens are primarily fragrances and essential oils incorporated into the formulation. The allergenic nature of a substance comes from its ability to bind to proteins present in the skin, which results in the production of antibodies. To avoid allergic reactions in consumers, the dosage of allergenic substances must be quantified. Consequently, every cosmetic manufacturer is obliged to disclose their presence on the labelling.
A closer look at the new cosmetic regulation concerning allergens.
On 26th July 2023, the European Commission published regulation No 1545/2023, amending the historic regulation No 1223/2009 of the European Parliament and Council regarding the labelling of allergenic fragrance substances in cosmetic products. New allergens have been added to the list, with the aim of protecting consumers. According to the latest estimates, the percentage of the population allergic to fragrance substances in the European Union is around 1 to 9%. Furthermore, an increase in the prevalence of eczema in the population has been observed in recent years, justifying the implementation of new protective measures.
What are the rules concerning allergens?
The measurement and labelling of allergens are strictly regulated by the European Commission. Indeed, there are thresholds that must not be exceeded regarding the concentration of allergenic substances in a skincare product. These thresholds depend on each allergen, the type of product and the level of exposure. They are defined by the IFRA (International Fragrance Association), an international association whose mission is to promote safer use of fragrances. Moreover, it is mandatory to mention allergens in the INCI list of cosmetic products if their concentration exceeds 0.01% in rinse-off products and 0.001% in leave-on products.
When will this new regulation come into effect?
We will have to wait until the 31st of July 2026 for the new allergen regulation to take effect. The new cosmetics that will be introduced to the market from this date will have to comply with the new legislation, and this will apply to both European companies and those introducing their product to the European Union market for the first time.
After which, the 31st of July 2028, these provisions will become applicable for the products already on offer for distribution. Manufacturers will then have three to five years to withdraw non-compliant cosmetic products from the market in accordance with the new labelling provisions.
What is the complete list of allergens?
There are now over 80 allergenic substances that have been identified by the Scientific Committee for Consumer Safety (SCCS) and officially listed in the European cosmetic regulation. They are grouped together in the table below.
